EQUAL DIVISION OF ASSETS
Court of Appeal judgment in Charman v Charman.
The latest case involving a “high net worth” divorce. However, the judgment is of relevance to divorcing couples (spouses and civil partners) no matter how much wealth there is to be divided up.
This is the latest case to add to the line of decisions since the House of Lords case of White v White. The judgment emphasises that when deciding how the assets should be divided, equality is the starting point and should only be departed from where there is a good reason to do so. The case provides greater emphasis for the argument that assets should be divided equally after divorce.
