Inheritance Act Disputes

The law in England and Wales has always recognised the right of its subjects to leave their property to whoever they like.

However, if equitable provision is not made for certain classes of dependants a claim may be made under the Inheritance (Provision for Family and Dependants) Act 1975 ("the Inheritance Act").

We advise clients on whether they have grounds to challenge a Will and write to the executors with a view to negotiation. If the executors do not cooperate, court proceedings will need to be issued. A judge can order executors to make suitable provision to a person who has been left out of a Will, or who would otherwise receive inadequate provision.
